Terms of Service

Effective from: 12 August 2026

§ 1. General provisions

  1. These Terms of Service set out the rules for using the naszprojekt.com website available at https://naszprojekt.com (the “Service”).
  2. The Service is operated by Małgorzata Powązka, conducting business under the registered business name Małgorzata Powązka Przedsiębiorstwo Produkcyjno-Handlowo-Usługowe "POW-ARCH", with its registered office at ul. Poprzeczna 31, 98-330 Pajęczno, Polska, Tax Identification Number (NIP): 5741769481, National Business Registry Number (REGON): 100602003 (the “Service Provider”).   3. These Terms constitute terms and conditions for the provision of electronic services within the meaning of Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services.
  4. Use of the Service constitutes acceptance of these Terms. These Terms are made available free of charge before the agreement is concluded and throughout the operation of the Service, in a manner that enables them to be downloaded, saved and printed.

§ 2. Definitions

  • User — any person who uses the Service.
  • Consumer — a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, as well as a natural person concluding an agreement directly connected with their business activity where that agreement is not of a professional nature for that person (an entrepreneur benefiting from consumer protection).
  • Account — a free User account in the Service that enables Projects to be saved in the cloud.
  • Project — a house concept (floor plan, building form and interiors) created by the User in the editor and saved in the Service or locally in the browser.
  • PDF Export — a paid service consisting of a one-time unlock of a PDF document download for a particular Project (floor plans, dimensions and schedules).

§ 3. Scope and types of services

  1. 3D editor (free, without registration) — designing a house in the browser. A working Project is saved exclusively in the local storage of the User’s browser (localStorage).
  2. Account (free) — after registration, the User may save Projects on the Service Provider’s server, use automatic saving and return to Projects from different devices.
  3. PDF Export (paid) — a one-time fee for unlocking a PDF download for one specific Project. The promotional launch price is PLN 9.99 gross (for the Polish version of the Service; regular price PLN 29 gross) or EUR 2.29 gross (for all other language versions; regular price EUR 7 gross), and is displayed in each case before payment. The fee is not a subscription and does not renew automatically. Purchasing a PDF Export does not require an Account.

§ 4. Technical requirements

To use the Service, the following are required: a device with Internet access, an up-to-date web browser supporting JavaScript and 3D graphics (WebGL or WebGPU), cookies enabled for sign-in and — for registration — an active e-mail address. The Service Provider is not liable for improper operation of the Service resulting from failure to meet these technical requirements.

§ 5. Account

  1. Registration takes place by providing an e-mail address and password or by signing in with a Google account. The Account service agreement is concluded upon registration for an indefinite period.
  2. The User is required to provide accurate information and not to make the Account available to third parties. The Service Provider is not liable for consequences resulting from the User disclosing access credentials to third parties.
  3. The User may terminate the Account service agreement and request deletion of the Account at any time by sending a message to biuro@naszprojekt.com. Deletion of the Account permanently deletes the Projects saved in it.
  4. The Service Provider may terminate the agreement or block an Account for valid reasons (a serious breach of these Terms, unlawful activity or abuse), after notifying the User.

§ 6. Rules of use and User content

  1. It is prohibited to provide unlawful content, attempt to compromise the security of the Service, use the Service automatically on a mass scale or take actions that disrupt its operation.
  2. Projects created by the User remain the User’s property. The Service Provider receives only a non-exclusive, royalty-free licence to store and process them to the extent necessary to provide the services (cloud storage, thumbnail generation and PDF Export). This licence applies only for the period during which the services are provided and expires when the User deletes the Project or Account, except for technical copies and backups.
  3. Elements of the Service (software, graphics, model catalogue and texts) are protected by copyright and belong to the Service Provider or its licensors.

§ 7. Payments

  1. Payments are processed by an external payment operator — Stripe. After selecting the payment option, the User is redirected to Stripe’s secure payment page, where the User provides payment details, their first and last name, billing address and e-mail address directly to the operator. The Service Provider neither receives nor stores payment-card details. The available payment methods are presented on the payment page.
  2. Paid PDF Export is offered exclusively to Consumers purchasing outside their business activity. The Service does not collect the purchaser’s Tax Identification Number (NIP) and does not issue business invoices.
  3. After payment has been confirmed, Stripe creates a personal invoice using the billing details provided by the User and sends it electronically to the e-mail address provided. The invoice and payment confirmation constitute proof of purchase, including for the purposes of restoring access and submitting complaints.
  4. All prices are gross prices (including taxes where applicable).
  5. The PDF Export service is activated immediately after the operator confirms payment and applies only to the Project for which it was purchased.
  6. When purchasing without an Account, the download unlock is linked to the Project and saved in the User’s browser (transaction identifier). Clearing browser data may result in the loss of this record; access may then be restored by contacting the Service Provider at biuro@naszprojekt.com and presenting the invoice or payment confirmation received from Stripe.
  7. The Service Provider does not guarantee that a payment can be technically assigned to a Project if the User does not use an Account, does not have the transaction number and is unable to demonstrate that the purchase was made.

§ 8. Right of withdrawal

  1. A Consumer may withdraw from a distance agreement within 14 days without giving any reason by submitting a statement to biuro@naszprojekt.com.
  2. PDF Export constitutes the supply of digital content not supplied on a tangible medium. Performance begins — with the Consumer’s express prior consent — immediately after payment, before the withdrawal period expires. Pursuant to Article 38(1)(13) of the Polish Consumer Rights Act, once the PDF file has been made available, the Consumer loses the right to withdraw from the agreement with regard to that service. The Consumer is informed of this before payment and also confirms it by selecting the relevant checkbox stating that, after placing the order and making payment, withdrawal from the agreement for the supply of digital content (the PDF Project) will no longer be possible.
  3. The right to withdraw from the free Account service agreement is exercised by requesting deletion of the Account (§ 5(3)).

§ 9. Complaints

  1. Complaints concerning the Service may be submitted to biuro@naszprojekt.com and should include a description of the issue, details enabling contact and the request to which the Service Provider is expected to respond.
  2. The Service Provider considers a complaint within 14 days of receipt and replies to the address from which the complaint was sent.
  3. If digital content does not conform to the agreement, the Consumer has the remedies provided for in Chapter 5b of the Polish Consumer Rights Act (bringing the content into conformity, a price reduction or withdrawal from the agreement).

§ 10. Nature of Projects — important disclaimer

The Service is a conceptual and visualisation tool. Projects, floor plans, dimensions, area schedules and cost estimates generated in the Service do not constitute a building design or an architectural and construction design within the meaning of the Polish Construction Law Act, are not prepared by a person holding the required building qualifications and cannot be used as the basis for obtaining a building permit or carrying out construction work. Construction requires documentation prepared by a designer with the appropriate qualifications. All numerical values (dimensions, areas and costs) are indicative. Photorealistic visualisations in a PDF Export may be processed generatively by artificial intelligence and, despite safeguards, may differ from the Project; the technical plans and views generated without AI remain the authoritative source for geometry, dimensions and schedules. The Service Provider does not guarantee that generated results comply with construction-law requirements, technical standards or local planning conditions. The Service Provider is not liable for any consequences resulting from a User using a Project generated in the Service for any purpose other than purely visual and illustrative purposes.

§ 11. Liability and availability of the Service

  1. The Service Provider makes every effort to ensure uninterrupted operation of the Service, but reserves the right to technical interruptions (maintenance, updates or failures). Where possible, Users will be informed of planned longer interruptions.
  2. Users are advised to make regular copies of important Projects. A working Project without an Account is stored in the browser’s local storage and will normally remain there after the page or browser is closed. However, the Service Provider has no technical means of restoring it if the User clears browser data, changes device or browser profile, or otherwise loses local data. Purchasing a PDF Export does not change how the working Project is stored.
  3. The User is responsible for making backup copies of data stored outside the Account.
  4. The Service Provider is not liable for data loss resulting from the operation of the browser, the User’s device or third-party software.
  5. The Service Provider is not liable for non-performance or improper performance of services caused by force majeure, including in particular failures of information and communications infrastructure, cyberattacks, power outages or actions of public authorities.
  6. Nothing in these Terms excludes or limits any liability of the Service Provider that cannot be excluded or limited in relation to a Consumer under mandatory provisions of law.

§ 12. Personal data and cookies

The rules for processing personal data and using cookies and similar technologies (including analytics and advertising tools: Google Analytics, Google Ads and Meta Pixel) are described in the Privacy Policy, which forms an integral part of the information made available to Users.

§ 13. Changes to the Terms

  1. The Service Provider may amend these Terms for valid reasons (a change in law, a change in the scope of services, security considerations or prevention of abuse).
  2. Users who have an Account will be informed of a change with appropriate advance notice (by e-mail or a notice in the Service). If a User does not accept the changes, the User may terminate the agreement before the changes enter into force by requesting Account deletion at biuro@naszprojekt.com.
  3. Services paid for before a change remain subject to the previous version of these Terms.

§ 14. Final provisions

  1. Polish law is the governing law, but this choice does not deprive a Consumer of protection afforded by mandatory provisions of the law of the country of the Consumer’s habitual residence.
  2. A Consumer may use out-of-court complaint and redress procedures, including assistance from a municipal or district consumer ombudsman, consumer organisations or permanent arbitration courts operating at the Polish Trade Inspection Authority.
  3. Matters not regulated by these Terms are governed by Polish law, in particular the Polish Civil Code, the Polish Consumer Rights Act and the Polish Act on the Provision of Electronic Services.
